A federal judge has dismissed the lawsuit brought by four members of the Cascio family against companies representing the legacy of Michael Jackson, ruling that the case cannot proceed in federal court and must instead be resolved through private arbitration.
The decision, issued on August 12, does not determine whether the allegations are true or false (we all know they are false). Instead, it decides where the dispute must be heard.
Why Was the Lawsuit Dismissed?
The Cascio siblings filed a federal lawsuit earlier this year, accusing Michael Jackson of years of sexual abuse during their childhood and alleging that companies connected to his Estate helped conceal that abuse. The Estate and the companies involved have denied all allegations and have described the lawsuit as an attempt to obtain more money after a previous settlement.
However, before the court could consider the allegations themselves, it first had to answer a different legal question: Should this case be heard in court at all?
Judge Hernán D. Vera ruled that it should not.
The judge found that the dispute is covered by an arbitration agreement signed as part of a previous settlement between members of the Cascio family and the Jackson Estate. Because of that agreement, the judge said the law required him to dismiss the federal lawsuit and allow the dispute to continue through private arbitration instead.
What Is Arbitration?
For those unfamiliar with legal terminology, arbitration is a private process used instead of a public courtroom.
Rather than having a judge and jury hear the case in open court, both sides present their evidence to an independent arbitrator, whose decision is generally binding. Hearings are usually confidential and are not open to the public.
This means the Cascio family’s claims have not been rejected on their merits. Instead, the court ruled that the claims must be heard in a different forum because of the agreement signed by the parties.
The Judge’s Reasoning
In his decision, Judge Vera acknowledged the seriousness of the allegations but said the court was legally required to enforce the arbitration agreement.
In other words, the judge was not deciding whether the allegations were true or false. His ruling was solely about enforcing the contract that both sides had previously entered into.
A Follow-Up to the March Ruling
Regular MJVibe readers may remember that, in March, we reported that a California judge had ruled this dispute should proceed through arbitration rather than in public court.
The August 12 ruling is the next step in that process.
While the March decision established that the dispute belonged in arbitration, the latest federal ruling formally dismisses the federal lawsuit, clearing the way for the case to proceed privately instead of through a public trial.
What Happens Next?
The dispute is now expected to continue in confidential arbitration.
Because arbitration proceedings are private, future developments may not become public unless one of the parties later asks a court to enforce or challenge the arbitrator’s decision.
For now, the federal court proceedings have come to an end, but the underlying legal dispute between the Cascio siblings and the companies representing Michael Jackson’s legacy is not over. It has simply moved from a public courtroom into a private legal process.
Will we know the outcome? Possibly not. Because arbitration is a private process, the final decision may never become public unless one of the parties later asks a court to enforce or challenge the arbitrator’s ruling. It is also possible that the Cascios go back to the TV screen to cry like babies again and possibly reveal the outcome. One thing many Michael Jackson fans will be hoping is that the Estate does not agree to another financial settlement with the Cascios, as it did previously. Whatever the outcome, transparency would allow the public to better understand how the dispute was ultimately resolved.
